Agreement
ADAShield Pro (getadashield.com and the ADAShield Android app) is provided by Elev8 AI Solutions & Services LLC (“we”, “us”). By creating an account or using the service, you agree to these terms and to our Privacy Policy. If you use ADAShield Pro for a business, you agree on behalf of that business. You must be at least 18.
What ADAShield Pro does
ADAShield Pro scans web pages for accessibility issues against the Web Content Accessibility Guidelines (WCAG), explains what it finds, and, on paid plans, generates suggested code fixes, reports, and documentation, and monitors your sites over time.
No compliance guarantee
ADAShield Pro does not guarantee that your website is, or will become, compliant with the Americans with Disabilities Act (ADA), WCAG, Section 508, the European Accessibility Act, or any other law or standard, and it does not guarantee that you will not receive a demand letter or lawsuit.
Automated testing detects only part of all possible accessibility issues; many WCAG requirements need manual testing with assistive technology. A high score, a passing grade, a badge, or a certificate from ADAShield Pro reflects the results of our automated checks on the date of the scan. It is not a legal opinion or a certification of legal compliance.
We are not a law firm and do not give legal advice. If you have received a demand letter or lawsuit, talk to a lawyer.
AI-generated fixes and content
Code fixes, alt text, captions, and other suggestions may be generated with artificial intelligence and can be wrong or incomplete. Review and test every change before you put it on your live website. You are responsible for the changes you make to your website and for backing it up first.
Your account
Give accurate information, keep your password secure, and tell us at support@elev8ai.org if you think someone else has accessed your account. You are responsible for activity under your account. Agency owners are responsible for the team members they add.
Acceptable use
You agree not to:
- Add sites for monitoring or request code fixes for sites you do not own or are not authorized to manage.
- Use the service to attack, overload, or probe systems, including private or internal networks, or to get around our rate limits.
- Scrape, resell, or copy the service, or reverse-engineer it except where the law allows.
- Use the service for anything unlawful or to harass anyone.
We may suspend or close accounts that break these rules.
Public reports
Free scans of public websites create public report pages, as described in our Privacy Policy. Website owners can ask us to remove the report for their site at support@elev8ai.org.
Plans, payments, and cancellation
Prices are shown on our website before you buy. Payments are processed by Stripe. Monthly plans renew automatically each month until you cancel. To cancel, email support@elev8ai.org from your account’s email address; cancellation takes effect at the end of the current billing period, and you keep access until then. One-time purchases are charged once.
Fees are non-refundable except where the law requires a refund or where we agree to one in writing. If you believe you were charged in error, email support@elev8ai.org within 30 days of the charge.
Purchases are made on our website only. The Android app does not sell plans; it lets you use the plan on your account.
We may change prices for future billing periods; we will email you before a change affects you.
Your content
You keep ownership of your websites, content, and data. You give us permission to access, scan, store, and process them as needed to provide the service. Code fixes and reports we generate for you are yours to use for your websites.
Availability and changes
We work to keep ADAShield Pro running but do not promise it will be uninterrupted or error-free. We may change or discontinue features. If we discontinue a paid service, we will refund any prepaid fees for the unused period.
Disclaimer of warranties
Except as stated in these terms, the service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent the law allows.
Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, or for legal claims, demand letters, settlements, or penalties brought against you by others. Our total liability for any claim related to the service is limited to the amount you paid us in the 12 months before the claim arose.
Indemnity
You agree to defend and hold us harmless from claims arising from your websites, the changes you make to them, or your breach of these terms.
Ending your account
You can delete your account at any time under Dashboard → Account (see account deletion), or by emailing support@elev8ai.org. Deleting your account stops any subscription from renewing; it ends at the close of the current billing period, with no further charges and no partial refund. We may close accounts that break these terms. Sections that by their nature should survive (such as no compliance guarantee, limitation of liability, and indemnity) survive after your account ends.
Governing law
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Pasco County, Florida, and both parties consent to those courts.
Changes to these terms
We may update these terms. We will change the date at the top and, for significant changes, email account holders before they take effect. Continuing to use the service after that means you accept the updated terms.
